Terms of Service

Epic Digital · Effective date: October 16, 2026

These Terms of Service ("Terms") govern your use of getepicdigital.com and book.getepicdigital.com (the "Sites") and the services provided by Epic Digital ("Epic Digital," "we," "us"). By using the Sites or our services, you agree to these Terms. If you do not agree, do not use them.

1. Our Services

Epic Digital is a marketing agency for home-service contractors (such as HVAC, plumbing, and electrical businesses). Our services may include website design and hosting, Google Business Profile management, local SEO, review generation, instant lead text-back, automated SMS follow-up, and monthly reporting. The specific scope, deliverables, and pricing for each client are set out in a proposal, order form, or agreement ("Service Agreement"). If a Service Agreement conflicts with these Terms, the Service Agreement controls.

2. SMS / Text Messaging Program

Program description: When you submit your phone number on our Sites (for example, when booking a demo call) and check the consent box, you agree to receive text messages from Epic Digital about your inquiry, appointment confirmations and reminders, customer care, and service updates. If you separately opt in to marketing messages, you may also receive offers and promotions. Consent is not a condition of purchase.

  • Message frequency varies.
  • Message and data rates may apply.
  • Opt out: reply STOP at any time to stop receiving messages. You will receive one confirmation message, and no further texts unless you opt in again.
  • Help: reply HELP for help, or email [email protected].
  • Carriers are not liable for delayed or undelivered messages.
  • Supported carriers include major U.S. carriers; availability may vary.
  • Your mobile information is handled as described in our Privacy Policy. We do not share mobile opt-in data or consent with third parties for marketing purposes.

Clients using our SMS tools: if we send texts to your customers on your behalf, you are responsible for having proper consent from those recipients and for complying with the TCPA, CTIA guidelines, carrier A2P 10DLC rules, and other applicable laws. You agree to provide accurate business information for carrier registration.

3. Payments and Retainers

  • Services are billed as a recurring monthly retainer, plus any setup or one-time fees stated in your Service Agreement.
  • Payments are processed by Stripe. By providing a payment method, you authorize us to charge it on a recurring basis until you cancel.
  • Fees are due in advance and are non-refundable unless your Service Agreement says otherwise or the law requires.
  • We may pause services for late or failed payments. Third-party costs (such as ad spend or software) are your responsibility unless stated otherwise.
  • We may change pricing with at least 30 days' notice.

4. Your Responsibilities

You agree to provide accurate information, timely access to accounts and materials we need, and to use our services only for lawful purposes. You confirm you have the rights to any content (logos, photos, text) you give us.

5. No Guarantee of Results

Marketing results depend on many factors outside our control, including search engine and platform algorithms, competition, and your own business operations. We do not guarantee any specific rankings, leads, reviews, calls, revenue, or other results. Any examples or case studies are illustrative only.

6. Intellectual Property

The Sites and our materials, templates, processes, and branding belong to Epic Digital or its licensors. You keep ownership of content you provide. Once paid in full, you receive a license to use the deliverables created for you for your business, except for third-party software, templates, and platform accounts (such as GoHighLevel), which remain subject to their own terms. You grant us permission to use your content to perform the services and, unless you tell us otherwise, to list your business name as a client.

7. Third-Party Services

Our services rely on third parties such as GoHighLevel/LeadConnector, Google, Stripe, Meta, and Wistia. We are not responsible for their availability, policy changes, suspensions, or actions.

8. Disclaimers

THE SITES AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EPIC DIGITAL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS BEFORE THE CLAIM AROSE.

10. Indemnification

You agree to indemnify and hold Epic Digital harmless from claims arising from your content, your use of the services, your violation of these Terms, or your violation of law (including messaging laws).

11. Termination

Either party may end services as described in the Service Agreement, or, if none is stated, with 30 days' written notice. We may suspend or terminate access immediately for non-payment, misuse, or violation of these Terms. Fees owed up to termination remain due. Sections that by their nature should survive (including payment, IP, disclaimers, limitation of liability, and indemnification) survive termination.

12. Governing Law

These Terms are governed by the laws of the United States and the state in which Epic Digital is organized, without regard to conflict-of-law rules. Any disputes will be resolved in the courts located in that state.

13. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted here with a new effective date. Continued use of the Sites or services means you accept the changes.
